Terms of Service

1. Acceptance of Terms

By creating an account or using the MeetCallie platform ("Service"), you ("User," "you," or "your") agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including businesses and their authorized representatives.

2. Description of Service

MeetCallie provides an AI-powered customer experience platform that enables businesses to automate post-sale quality check phone calls, collect feedback via AI voice agents, and send SMS-based review invitations to satisfied customers. The Service includes AI agent configuration, call scheduling, sentiment analysis, and Twilio-powered SMS routing.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding agreement to use the Service. By using MeetCallie, you represent that you meet these requirements and that all information you provide is accurate and complete.

4. Your Responsibilities

4.1 Customer Consent

You are solely responsible for ensuring that any customer whose phone number you upload has expressly consented to receive automated calls and text messages from your business under applicable law including, without limitation, the Telephone Consumer Protection Act (TCPA), Canada's Anti-Spam Legislation (CASL), and any other applicable telecommunications regulations.

4.2 Accurate Data

You agree to provide accurate business information including your business name, industry, Google Review URL, and notification phone number. Inaccurate data may affect AI agent performance and is your responsibility.

4.3 Lawful Use

You agree not to use MeetCallie to contact individuals who have opted out of communications, to harass, threaten, or deceive customers, or for any unlawful purpose.

4.4 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. AI Voice Calls & SMS

The Service enables AI-generated voice calls placed to your customers via Retell AI, and SMS messages delivered via Twilio. You acknowledge and agree that:

  • AI-generated calls are placed from phone numbers you register through the Platform
  • SMS messages are delivered from your configured Twilio number
  • You are the originator of record for all calls and messages placed through the Platform
  • You will ensure compliance with all applicable calling and texting laws in the jurisdictions where your customers reside
  • MeetCallie is not liable for calls or SMS that are blocked, filtered, or rejected by telecommunications carriers

5.1 SMS/Text Messaging Program Terms

Program Description: MeetCallie sends post-service quality check links to customers, and negative feedback alerts to business owners.

Message Frequency: Message frequency varies based on customer volume and interaction.

Pricing: Message and data rates may apply.

Opt-Out: You can opt-out of receiving SMS messages at any time by replying STOP. After sending STOP, you will receive one final confirmation message, and no further messages will be sent.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.

6. Subscriptions & Billing

Subscription Plans: MeetCallie offers paid subscription plans billed monthly or annually. Plan details and pricing are displayed at the time of purchase.

Payment: All payments are processed securely by Stripe. By subscribing, you authorize MeetCallie to charge your payment method on a recurring basis.

Cancellations: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.

Failed Payments: If payment fails, your account may be suspended until payment is resolved.

7. Prohibited Activities

You agree not to:

  • Use the Service to place calls or send messages without the recipient's prior express written consent
  • Use the Service to contact numbers on national or state Do-Not-Call registries without proper exemption
  • Impersonate any person or entity or misrepresent your affiliation
  • Attempt to reverse-engineer, hack, or exploit the Platform
  • Resell or sublicense the Service without express written permission from MeetCallie
  • Upload content that is defamatory, obscene, or violates any third-party rights

8. Intellectual Property

The MeetCallie name, logo, platform, AI agent system prompts, and all associated content are the intellectual property of MeetCallie or its licensors. Nothing in these Terms gives you a right to use our name, logos, or trademarks without prior written consent. You retain ownership of the business data and customer data you upload to the Platform.

9. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. MeetCallie makes no warranties, express or implied, including without limitation:

  • That the Service will be uninterrupted, error-free, or secure
  • That AI sentiment analysis results will be 100% accurate
  • That SMS messages will be delivered by telecommunications carriers
  • That use of the Platform will result in increased reviews or revenue

10. Limitation of Liability

To the fullest extent permitted by applicable law, MeetCallie and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, data loss, or TCPA/CASL violations arising from your failure to obtain proper customer consent. Our total liability to you for any claim arising out of or related to the Service shall not exceed the total amount you paid to MeetCallie in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless MeetCallie and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any calls or messages placed through the Service without proper consumer consent.

12. Termination

MeetCallie reserves the right to suspend or terminate your account immediately and without notice if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that could expose MeetCallie or third parties to liability. You may terminate your account at any time by cancelling your subscription and contacting us.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a notice on the Platform at least 7 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
